PROCEDURE FOR GIVING NOTICE OF TERMINATION OF TENANCY AGREEMENT


Do you have a fixed-term contract for a maximum of 24 months (independent) or a maximum of 5 years (non-independent)? Then the landlord may indicate towards the end of the rental agreement that he does not want to extend the rental agreement. The landlord then issues a notice of termination of the rental agreement. This page will tell you what this means for you.



WHAT TO DO... NOTICE END OF RENTAL CONTRACT?

Step 1 - RECEIVE NOTICE

You will receive a notification of the end of your rental agreement by e-mail. You can expect this within 3 to 1 month before your tenancy agreement expires. We ask you to respond to this mail with a confirmation so that we know you are aware of this notice.

Step 2 - PRE-INSPECTION OF YOUR PROPERTY

When you leave your rental home, you must leave it clean and damage-free. To alert you to any damage that needs to be repaired and to give you the opportunity to repair it, we carry out a pre-inspection 6 to 4 weeks before the end of your tenancy agreement. To establish the general condition of the property, a report will be made with photos. This will include whether all facilities in the property are functioning properly.  


If there are any damages or defects that are your responsibility, you will have ample time to rectify them before permanently leaving the property. If you fail to do so, the cost of repairs will be your responsibility. It is no longer possible to carry out repairs once you have returned the key after the outcheck. 

 

The house must be left empty and swept clean at check-out. Max Rental will do the final cleaning. This pre-inspection appointment takes about 1 to 1 ½ hours. You will receive a copy of the report detailing the defects found during the pre-inspection that you must fix yourself before the outcheck. 


Step 3 - OPEN HOUSE

When you sign your tenancy agreement, you have agreed to cooperate in 2 open houses. We will schedule these together with you. The real estate agent will come by the property for a viewing with several candidates. We will need about 30 minutes. 

Step 4 - THE OUTCHECK

The outcheck takes place on the last day of the tenancy agreement. During the outcheck, we take stock of the general condition of the property with you. We will also check whether the points from the pre-inspection report have been resolved. The house must be vacated empty (except for the inventory that belongs to the rented property) and swept clean, free of personal belongings. Do not forget the storage room, garden or balcony!


Once the report with the photos has been drawn up, you will receive a copy and it will be compared with the check-in report. If there are any damages that you should pay for, you will be notified. 

 

Please note! You must have the property completely ready for closing before the outcheck + key transfer. It is not possible to enter the property after the outcheck.

Step 5 - PAYMENT ARREARS

Make sure you are not in arrears with rent payments, service charges, NUTS agreements and/or repair costs. This will prevent high collection costs and negative credit registration. 

Step 6 - TERMINATE SERVICE CONTRACTS

After the key transfer, you can cancel your contracts, with the meter readings noted. These include gas, water, electricity, internet, telephone, television, and any other service contracts.

Step 7 - SIGINIG OUT FROM THE BRP

You must deregister from the BRP, which is the municipality's basic register of persons, within one week. It is not desirable to have tenants registered at the address where they do not live. 

Step 8 - RETURNING YOUR DEPOSIT

The final inspection will determine how the property has been delivered.  If there are any defects in the property that arose during your tenancy, the repair costs will initially be deducted from the deposit. You will also need to prove that you have deregistered from the address. Until you have deregistered from the address with the municipality, the deposit cannot be returned. The deposit (or the remaining amount) will be refunded to you by the landlord within 4 weeks, provided you have met the conditions. 

Step 9 - PASSING ON YOUR CHANGE OF ADDRESS

As there may still be mail sent to your old rental property, it may be wise to arrange a forwarding service with Post.nl. This way you will continue to receive all mail.
